Parents going through a divorce in Nebraska may be very concerned about how much time they will get to spend with their child post-divorce. It is essential that any child custody arrangement serves the best interests of the child. The following is a brief overview of legal custody and physical custody in Nebraska.

What is legal custody?

Legal custody is the right of a parent to make key life decisions on behalf of the child. Some examples of these decisions include the child’s education, health care decisions and the child’s religious upbringing. Legal custody can be either joint, meaning both parents can make these decisions, or sole, meaning only one parent has the right to make these decisions.

What is physical custody?

Physical custody refers to where the child lives on a day-to-day basis. For example, one parent may have the child one weeknight and every-other weekend, while the other parent has the child the rest of the time. Or, parents might split custody time more evenly, with each parent having custody on alternate weeks. Who has the child on holidays and summer break are also part of a physical custody arrangement. Like legal custody, physical custody can be sole or joint. The child’s wishes are one factor courts will consider when determining physical custody.
